Article 2. Applicability

These general terms and conditions apply to every offer made by the Trader (BULBi) and to every contract concluded between the Trader and the Purchaser.

Accepting an offer or placing an order implies that you accept the applicability of these Terms and Conditions. The provisions of these Terms and Conditions may only be deviated from after written notification or written approval by BULBi, in which case the other provisions will remain in full force.

These Terms respect the consumer's rights under the law (or the sales agreement).

Agreements between the Trader and the Purchaser to which these general terms and conditions relate are exclusively governed by Dutch law.

Article 3. The Offer

All offers by BULBi are non-binding and BULBi expressly reserves the right to change prices, in particular when required by (statutory) regulations. An agreement only comes into effect after the Trader accepts an order made by the Purchaser.

The Trader is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stipulated otherwise.

The Offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to allow a proper assessment of the Offer by the Purchaser. The images used by the Trader are as accurate as possible to offer a true representation of the products offered.

Offers are non-binding unless otherwise stated. Errors made in the Offer render the Offer void.

Article 4. Cancelling an order

Cancellations must be reported via our e-mail address info@bulbi.nl. Unprocessed orders may be cancelled immediately, free of charge. Processed or shipped orders require the reimbursement of costs incurred. Costs include shipping and processing costs. For reimbursement, the Trader will use the same means of payment that the Purchaser has used, unless the Purchaser agrees to pay by an alternative method.

 

Article 5. Prices

The stated prices of the products offered are in Euros (EUR), including VAT but excluding shipping costs. Invoices do not include Purchaser VAT numbers.

Article 6. Delivery

The delivery time for BULBi products is tailored to the planting season. Orders may be placed outside the planting season and the products will be delivered during the planting season for the delivery region. Within the planting season, orders will be dispatched within a week. The shipping period is detailed on the order confirmation.

The Purchaser will be informed of unforeseen deviations in the delivery times. If the shipment (from the moment of shipment) takes longer than thirty (30) days, both the Trader and the Purchaser have the option to dissolve the purchase agreement in writing, after which both parties are released from their obligations towards each other and any payments already made will be refunded. Any delivery times stated by BULBi shall be indicative only. Exceeding any delivery period does not entitle you to compensation.

The Trader insures the bulbs during transportation.

Shipping of the products shall take place at the place and time at which the products are ready for transportation. The place of delivery is the address that the Purchaser has made known to the Trader.

Article 7. Right of withdrawal

Our flower bulbs, tubers, rootstocks and perennials are excluded from the standard right of cancellation due to their limited shelf life.

Complaints about delivered products can only be accepted if the product is damaged or delivered incorrectly. If the product is damaged or wrongly delivered, the Trader must be informed by means of a written explanation and illustrative photos within three (3) days of delivery. A suitable solution will be sought in consultation with the Purchaser. Severely damaged products do not have to be returned.

 

Article 8. Availability of articles

Flower bulbs are a natural product. Availability depends on the harvest. Despite careful planning, it may happen that ordered products are unexpectedly unavailable or very limited in supply. In this case, the Trader will inform the Purchaser in writing and suggest a suitable replacement.

 

Article 9. Responsibility

The Purchaser is entirely responsible for the use of the delivered goods. The Trader is not liable for negative consequences of injudicious, improper or incorrect use or misuse.

 

Article 10. Retention of title

Ownership of delivered products shall not be transferred until the Purchaser has fully settled the invoiced amount for the order to the Trader under the agreement. The risk of loss of or damage to the products included in the agreement is transferred to the Purchaser at the moment they are legally and/or actually delivered and thus come into the possession of the Purchaser or a third party to be designated by the Purchaser.

Article 11. Complaints

Products must be examined upon delivery. If the delivered products do not comply with the agreement the Purchaser inform the Trader as soon as possible and in any case within three (3) working days after delivery via the e-mail address info@bulbi.nl.

The requirements for the growth and flowering of bulbs, tubers and rhizomes can be very specific. The Trader does not guarantee that the bulbs, tubers and rootstocks will grow and flower in every climate and under all conditions.

It is the Purchasers responsibility to plant and care for the bulbs, tubers and rootstocks at the right planting time and under the right conditions.

The Trader is not liable for disappointing or complete failure of flowering. Complaints will only be considered:

- Upon receipt of up to 3 photos of the product in question and indication of the order number.

- Upon receipt of a description of the planting and growing conditions (e.g. planting period, climate and condition of the product).

- After the flowering period of the relevant product.

The flowering guarantee is only valid on the first flowering period after purchase of the relevant product via www.bulbi.nl or www.bulbi.co.uk. The flowering guarantee does not apply to damage resulting from improper care or extreme weather conditions such as frost.

If it is established that flowering is lagging behind as a result of poor product quality, a suitable solution will be sought together with you. The Trader is not liable for further costs incurred such as labour. Compensation will not exceed the value of the product.

Due to availability and growing seasons, replacements may not be possible until the next harvest season.

The Purchaser is required to allow the Trader four (4) weeks to solve the complaint by mutual agreement.

 

Article 12 - Illustrations website

Products are illustrated as accurately as possible. However, flowers and plants are a natural products that adapt to local conditions such as light and soil type. As a result, flowering may differ slightly in e.g. size and colour compared to the illustrations, descriptions and specifications on the Trader’s website.

Illustrations and images featured on the Trader’s website are protected by copyright and may therefore not be reproduced in whole, in part or in modified form without express written permission.
