Article 2. Applicability

All offers, orders and agreements of BULBi are subject to these General Terms of Delivery. Accepting an offer or placing an order means that you accept the applicability of these Terms and Conditions. Deviations from what is stipulated in these Conditions are only possible after written notification or written approval by BULBi, in which case the other provisions will remain in full force. All rights and claims stipulated in these Conditions, and in any further agreements for BULBi, are also stipulated for the benefit of intermediaries and other third parties engaged by BULBi. These conditions respect the rights of the consumer that arise from the law (or the sales agreement).

Article 3. Offers/agreements

All offers made by BULBi are without obligation and BULBi expressly reserves the right to change prices, in particular when this is necessary on the basis of (statutory) regulations. An agreement is only concluded after BULBi has accepted your order. 
BULBi is entitled to refuse orders or to attach certain conditions to delivery, unless expressly stated otherwise. If an order is not accepted, BULBi will state this within ten (10) working days of receiving the order.

Article 4. Cancelling orders

Cancellations should be reported via our email address info@bulbi.nl. The buyer has the right to cancel within five working days. If your order has not yet been processed, you may cancel it immediately at no cost. If your order has already been dispatched, you are obliged to reimburse the costs incurred. The costs consist of the shipping and order costs.

Article 5. Prices

The prices listed for the products offered are in euros, including VAT but excluding shipping costs. As of 1 July 2021, new EU VAT (sales tax) rules are in force for E-commerce companies. This change affects the price after tax that consumers within the European Union pay in our webshop.  As per July 1st 2021, the EU country specific VAT rate (instead of the 9% rate) will be calculated in the prices. So if you see small price changes and/or no longer see nicely rounded prices, this is the reason behind it. It may also affect the final freight costs. All BULBi webshop customers pay the same product price without VAT.

Article 6. Delivery

The delivery time for flower bulbs on BULBi is tailored to the planting season. Outside the planting season you can place an order, which will be delivered during the planting season for your region. During the planting season your order will be shipped within a few days to a maximum of one week. The flower bulbs are sent insured. In the event of an unforeseen deviation in the delivery times, we will inform you. If the force majeure situation lasts longer than thirty (30) days, both BULBi and the buyer have the option of dissolving the agreement in writing, after which both parties will be released from their obligations to each other and any payments already made will be refunded. Any delivery times given by BULBi are indicative only! Exceeding any delivery period does not entitle you to compensation. Products will be delivered at the place and time at which they are ready for dispatch to you.

Article 7. Right of withdrawal

No statutory right of withdrawal applies to fresh products such as flower bulbs in connection with perishable goods. Complaints about the delivered products can only be handled if the product is damaged. If the product is delivered damaged, BULBi must be informed of this by means of a photo within 14 days. If there is indeed damage, a suitable solution will be sought in consultation with the consumer. Seriously damaged products do not have to be returned.

Article 8. Delivery of products

Flower bulbs are a natural product. The availability depends on the harvest results of our own cultivation and that of our suppliers. Despite careful planning, it may happen that an article is unexpectedly not available or is available on a very limited basis. In that case BULBi will suggest a suitable replacement by e-mail.

Article 9. Responsibility

The customer is solely responsible for the use of the delivered goods. BULBi is not liable for negative consequences of injudicious, improper or incorrect use or misuse.

Article 10. Retention of title

Ownership of delivered products will not be transferred until you have paid everything owed to BULBi under the agreement. The risk of loss or damage to the products that are the subject of the agreement will pass to the consumer at the moment that they are legally and/or actually delivered and thus become the property of the consumer or a third party designated by the consumer.

Article 11. Complaints

You are obliged to check upon delivery whether the products delivered comply with the agreement. If this is not the case, you must inform BULBi as soon as possible and in any event within two (2) working days of delivery via the e-mail address info@bulbi.nl
